1. Introduction

Welcome to Whali. These Terms of Service ("Terms") govern your access to and use of the Whali website at whali.co.uk and our services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Whali provides a platform connecting students with internship opportunities in Finance and Consulting, including a weekly opportunities newsletter and interview placement services.

Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our Service.

2. Eligibility

To use our Service, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete information when creating an account

3. Account Registration

To access certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Services Offered

4.1 Weekly Opportunities Newsletter

Our subscription service provides access to curated internship opportunities in Finance and Consulting. Subscriptions are available on a weekly or monthly basis as displayed on our pricing page.

4.2 Interview Placement Service

We offer an interview placement service that helps connect qualified candidates with potential employers through outreach automation. This service is subject to separate terms and approval processes.

4.3 Service Limitations

While we strive to provide accurate and up-to-date information, we do not guarantee:

  • The accuracy or completeness of any internship listings
  • That you will receive any interviews or job offers
  • The availability of any specific opportunities
  • Uninterrupted access to our Service

5. Subscriptions and Payments

5.1 Pricing

Current subscription prices are displayed on our pricing page. All prices are in British Pounds (GBP) and include VAT where applicable.

5.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorise us to charge the applicable fees to your payment method.

5.3 Subscription Terms

  • Weekly Access: One-off payment for access to the current week's opportunities.
  • Monthly Subscription: Recurring subscription that renews automatically each month until cancelled.

5.4 Cancellation

You may cancel your monthly subscription at any time by contacting us at admin@whali.co.uk. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial periods.

5.5 Refund Policy

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

  • You have 14 days from the date of purchase to cancel and request a refund, provided you have not accessed the paid content.
  • By accessing the paid content within the 14-day period, you acknowledge that you lose your right to cancel.
  • Refund requests should be sent to admin@whali.co.uk.

6. User Conduct

When using our Service, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Submit false, misleading, or fraudulent information
  • Share your account credentials with others
  • Redistribute, resell, or share subscription content without authorisation
  • Use automated systems to access the Service without permission
  • Attempt to interfere with or disrupt the Service
  • Upload malicious code or content
  • Harass, abuse, or harm other users or our staff
  • Use the Service for any unlawful purpose

7. User Content

7.1 Your Content

You retain ownership of any content you submit to our Service, including CVs and application materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process such content for the purpose of providing our Service.

7.2 Content Standards

You represent and warrant that your User Content:

  • Is accurate and not misleading
  • Does not infringe any third-party rights
  • Complies with all applicable laws
  • Does not contain defamatory, offensive, or illegal material

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Whali and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included content without our express written permission.

9. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by Whali. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Internship listings are provided by third-party employers. We do not guarantee the accuracy of these listings or endorse any particular employer.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of any content

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Whali shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business
  • Loss of data or goodwill
  • Service interruption or computer damage
  • Failure to obtain any interviews or employment

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

These limitations apply regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Whali and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions that by their nature should survive termination will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Whali regarding the Service and supersede all prior agreements and understandings.
