Please read these Terms of Service carefully before using Whali. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using the Whali platform ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Whali is an AI-powered outreach platform designed to help students and recent graduates connect with professionals and companies. The Service includes CV/resume parsing, lead generation, AI-assisted email drafting, email sending and tracking through your own email account, and follow-up automation.

3. Account Registration & Security

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorised access. You must be at least 18 years old to use the Service.

4. Subscriptions, Billing & Credits

The Service operates on a subscription model with different tiers. Each tier includes a monthly allocation of credits that are consumed when you use platform features such as generating emails, searching for leads, and enriching contact data.

Subscriptions begin immediately upon checkout. You can explore Whali's features during onboarding before subscribing.

Credits reset at the beginning of each billing cycle and do not roll over. Unused credits expire at the end of each billing period.

Payments are processed by a third-party payment processor. By subscribing, you authorise recurring charges to your chosen payment method.

Refunds are handled on a case-by-case basis. If you believe you have been charged in error, please contact us within 14 days of the charge.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access until then.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Send unsolicited bulk emails or spam
  • Violate any applicable laws, including anti-spam legislation (such as CAN-SPAM, GDPR, PECR, or equivalent regulations in your jurisdiction)
  • Send misleading, fraudulent, or deceptive communications
  • Harass, threaten, or abuse any individual
  • Impersonate another person or entity
  • Attempt to interfere with or disrupt the Service
  • Scrape, crawl, or use automated means to access the Service beyond its intended functionality

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated this policy.

6. Email Integration

The Service allows you to connect your own email account (Gmail or Outlook) to send emails through the platform. You retain full control of your email account at all times.

You are solely responsible for the emails you send through the Service. The Service acts as a tool to facilitate sending — you review and approve each email before it is sent.

We do not read, store, or access your inbox beyond what is strictly necessary to send emails and track responses on your behalf.

7. AI-Generated Content

The Service uses artificial intelligence to generate email drafts and outreach suggestions. AI-generated content is provided as a starting point and may contain errors, inaccuracies, or inappropriate suggestions.

You are solely responsible for reviewing, editing, and approving all AI-generated content before sending. Whali is not liable for any consequences arising from emails you choose to send.

8. CV/Resume Data

When you upload your CV or resume, we parse and store structured data from it to personalise your outreach emails. You retain ownership of your CV data. You may delete your CV data at any time from your account settings. Please refer to our Privacy Policy for details on how we handle your data.

9. Lead & Contact Data

Lead and contact data provided through the Service is sourced from third-party data providers. We do not guarantee the accuracy, completeness, or currency of this data.

You agree to use lead data only for legitimate professional outreach purposes and in compliance with applicable data protection laws.

Whali is not responsible for the accuracy of third-party data or for any consequences arising from your use of such data.

10. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of Whali Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

You retain ownership of content you create or upload (CVs, email drafts, notes). By using the Service, you grant us a limited licence to process your content solely for the purpose of providing the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Whali Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us or through your account settings.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
